If we turn the option "rebuild palace if capital is conquered" off, do we still suffer civil war when the capital is conquered?

Yes. The option you're referring to simply means that you automatically get a free, new palace (might also apply to some other "small wonders" in rulesets other than the default one) whenever you lose your old one. Civil war only depends on the city being conquered being your capital at the time it was conquered, it isn't affected by whether or not your palace is automatically rebuilt somewhere else in any way.

Methinks other small wonders aren't automatically recreated for free in a random city. (Untested, I have savepalace FALSE as the only locked option, and Eiffeltower as small wonder to get two build slots in at most one chosen city per player, instead of the silly AI love.)

Yes, in the supplied rulesets the Palace is the only Small Wonder with "SaveSmallWonder" flag set.
