Yeah, I'm uncertain which method would be best, but my gut says that since it's skill-based, it should just be for example, when you have 40% of success, and 10% tie chance, then 0-40 would be critical fail, 41-50 would be 'tie'/regular fail, and 51-100 would be successful. If tie chance increased to 20%, then it would be 1-30 critical fail, 31-50 'tie', 51-100 success. Thus with skilled enough diplomats/spies the critical fail chance could even be eliminated against unskilled ones.
So it would simply be a check, rather than an extra roll. Is that clearer?
